A settlement has been reached with Columbia Natural Resources, LLC (formerly Columbia Natural Resources, Inc.), NiSource Inc., Columbia Energy Group and Chesapeake Appalachia, L.L.C. ("Defendants") about royalty payments on oil and gas leases in West Virginia. These leases were or are now held by Columbia Natural Resources, Inc., Columbia Natural Resources, LLC, or Chesapeake Appalachia, L.L.C., all of whom are collectively referred to in this case as "CNR".

The lawsuit claims that CNR did not pay the appropriate royalties for their leases and that CNR defrauded Class Members. The lawsuit claims that people may be due royalty payments from CNR. Defendants deny liability, fault, and wrongdoing but they have agreed to make the settlement payment as outlined in the notice for the sole and exclusive purpose of compromising and settling this litigation, buying peace, and avoiding or eliminating the expenses and hardship of further litigation. The total amount of the settlement is $380 million for all 10,404 members of the Class. The Court has scheduled a hearing on Saturday, November 22, 2008, at 9:00 a.m., at the Roane County Courthouse, in Spencer, West Virginia, to decide whether to approve the settlement.
